(02) — The rules

How injury claims work in Florida

General information, not legal advice. Laws change, and exceptions apply to many of these rules.

Filing deadline

2 years

Most negligence lawsuits must be filed within 2 years. Florida shortened this deadline from 4 years for claims arising after March 24, 2023.

Wrongful death

2 years

A wrongful death lawsuit generally must be filed within 2 years of the death. It’s brought by the personal representative of the estate on behalf of the family.

Fault rule

Modified comparative fault

If you’re found more than 50% at fault for your own injury, you generally can’t recover damages. At 50% or less, your award is reduced by your share of fault.

Car insurance

No-fault (PIP)

PIP coverage pays part of your medical bills and lost income, up to $10,000, no matter who caused the crash — generally only if you get initial care within 14 days. To sue for pain and suffering, the injury usually must be permanent or meet another legal threshold.

Claims against the government

3-year notice

Before suing a state agency, county or city, you generally must give written notice within 3 years (2 years for wrongful death) and allow time for review. Damages are generally capped at $200,000 per person and $300,000 per incident.

Dog bites

Strict liability

Owners are generally liable for bites even if the dog never showed aggression before. The victim’s own negligence — or, in some cases, a posted “Bad Dog” sign — can reduce or limit that liability.

  • For most negligence claims that arose after March 24, 2023, the deadline is 2 years. Wrongful death claims also have a 2-year deadline, and claims against government agencies have separate notice rules. Because exceptions exist, it’s wise to get guidance early.

  • Florida PIP generally pays medical benefits only if you receive initial care within 14 days of the crash. Even if you feel fine, getting checked promptly protects both your health and your coverage.

  • Yes, as long as you were not more than 50% at fault. Your compensation is reduced by your percentage of fault, and above 50% you generally can’t recover. Different rules apply to medical negligence cases.

  • Sometimes. Because Florida is a no-fault state, a claim against the at-fault driver for pain and suffering generally requires a permanent injury, significant permanent scarring, or another threshold set by law. Your medical records play a large role.
